STANDARD TERMS AND CONDITIONS OF SALE
1.Applicability of Terms
The client explicitly waives its own standard terms and conditions, even if these were issued after these Standard Terms and Conditions of Sale. Any deviation from these terms shall only be valid if expressly agreed in writing in advance by Elegance Touch.
2. Payment Terms
Unless otherwise stated in writing, all invoices are payable in advance.
Elegance Touch reserves the right to suspend or cancel any order, delivery, or service without prior notice in the event of late payment or non-payment.
3. Late Payment
If payment remains outstanding for more than sixty (60) days after the due date, Elegance Touch reserves the right to initiate legal proceedings against the client. All legal and recovery expenses shall be borne entirely by the client.
4. Taxes and Withholding
Certain countries may apply withholding taxes on invoice payments according to their national legislation. Any such withholding shall be borne solely by the client and paid to the relevant authorities. Under no circumstances shall Elegance Touch be responsible for costs arising from local tax regulations. The full invoice amount remains payable to Elegance Touch.
5. Delivery and Inspection
Clients must inspect the goods upon delivery and before accepting the shipment from the delivery company.
Any visible damage (such as breakage or structural damage) must be immediately reported to the delivery personnel and recorded on the delivery receipt.
Once the delivery has been accepted and signed for, the goods shall be considered received in good condition, and Elegance Touch shall not be responsible for any damage claims submitted afterward.
6. Claims
To be admissible, any claim must be notified to Elegance Touch in writing within three (3) days of delivery. Claims submitted after this period will not be accepted.
7. No Return / No Refund Policy
All sales made by Elegance Touch are final.
Returns, refunds, or exchanges will not be accepted except in cases where the product has verified physical damage at the time of delivery and such damage was recorded on the delivery receipt.
The following situations are not considered defects and shall not justify return, replacement, or refund:
- Color variations
- Differences in material texture or finishing
- Customer preference or change of mind
- Minor variations due to lighting or photography
8. Limitation of Liability
Elegance Touch shall not be liable for any indirect, incidental, or consequential damages arising from the use of its products. The company’s liability, if any, shall not exceed the value of the purchased product.
9. Governing Law
All contractual relations with Elegance Touch shall be governed exclusively by the laws of Iraq. Any disputes shall fall under the jurisdiction of the competent courts of Iraq.
